Students released on bail after alleged assault

Three men who allegedly assaulted cleaner Delia Adonis were released on bail on Wednesday following an urgent application to the Western Cape High Court, their lawyer said.

“I brought an urgent application to the High CRT [Court] and at 5pm I argued the matter and bail was fixed for all three,” lawyer William Booth said in an sms to Sapa.

“There were no legal grounds to have them held in custody and the mag[istrate] was wrong to not fix bail yesterday [Tuesday] and have them detained in prison.”

The Wynberg Magistrate’s Court had ordered the three to remain in custody in Pollsmoor prison until Thursday, he said.

“They have to appear tomorrow [Thursday] in Wynberg CRT [Court],” Booth said.

“…The prosecutor yesterday had no grounds to oppose bail and that it is irregular to oppose bail when there is no legal reason to do so.”

Booth said he would address the court on some “pertinent aspects” regarding the case, and about the way some prosecutors deal with cases.

On Wednesday morning, IOL.co.za reported that the three men, one a University of Cape Town student, were charged with attempted murder after Adonis was assaulted in Cape Town.

The three men appeared in the Wynberg Magistrate’s Court on Tuesday, where they were also charged with assault with intent to do grievous bodily harm and crimen injuria, according to the report. SAPA
