Sibiya could know disciplinary outcome soon

The outcome of a disciplinary inquiry into Gauteng Hawks head Major General Shadrack Sibiya’s alleged involvement in the rendition of a group of Zimbabweans could be known on Thursday, Hawks spokesperson Brigadier Hangwani Mulaudzi said.

“We are waiting for a decision from the chairperson,” said Mulaudzi.

He explained that if the chairperson did release his findings on Thursday, the decision would be directed to Sibiya’s lawyers, as well as to the legal department of the Department for Priority Crime Investigation (DPCI), otherwise known as the Hawks.

After that, both parties had five days to go through the decision and if any other representations were to be made, they would be made within those five days. “After that a final decision is made,” he said.

Sibiya was suspended on January 20 2015 and his disciplinary hearing was held in Pretoria in June to establish whether he knew about, or was present as claimed by some witnesses, at the arrests and subsequent illegal deportation of the Zimbabweans wanted for the killing of a policeman in that country.

Sibiya denied the claims, saying they were an act of revenge by former crime intelligence head Richard Mdluli, following an investigation into whether Mdluli had killed a love rival, Oupa Ramogibe.

Mdluli had also faced fraud and corruption charges relating to a secret police fund in a case at the Commercial Crimes Court, which has subsequently been taken off the roll over problems to declassify certain documents.

The rendition allegations, first reported by the Sunday Times, have already been linked to the departure of national Hawks head Anwa Dramat, who allegedly knew about it, and a disciplinary hearing for Independent Police Investigative Directorate head Robert McBride, who supposedly altered a report to clear Dramat.
