Madonsela heads to court on her last day as PP

Public Protector Thuli Madonsela will release her last batch of reports on her last day in the job in Pretoria on Friday afternoon. She had also been expected to release a preliminary report on her investigation into state capture‚ but it is unsure if she will as President Jacob Zuma has filed an application to interdict the release of that report.

The application is set to be heard in the High Court in Pretoria on Tuesday‚ when new Public Protector Busisiwe Mkhwebane will be in charge.

Co-operative Governance and Traditional Affairs Minister Des van Rooyen has reportedly brought a court application to try stop the release of the report‚ which will be heard on Friday..

A source in Madonsela’s office indicated on Thursday night that: “We cannot proceed to release the report until the court has decided whether or not to grant the interdict.”

Her investigation into allegations of state capture looked into the alleged involvement of the Gupta family in the dismissal and appointment of Cabinet ministers and members of boards of directors of state-owned enterprises.

Earlier this week‚ Madonsela said it was in the interest of Zuma to account for what he knows regarding the allegations about state capture which had been forwarded to him in March.

She was reacting to a statement from the Presidency issued on Monday‚ in which Zuma requested her to allow him to question other witnesses‚ determined by the public protector‚ who have appeared before public protector.

“The Public Protector would like to report that President Jacob Zuma was afforded a proper opportunity to tender his evidence since 22 March 2016.

“President Zuma was on Saturday‚ October 01‚ 2016‚ given all copies of evidence implicating him‚” the Public Protector said in a statement issued on Monday night.

Madonsela indicated on Thursday that she will also update the public on progress in respect of other investigations‚ likely to include the state capture investigation.
